The Top Ten Consumer Infringement Events in 2018

Changchun Changsheng vaccine incident was severely punished.

Comment: The problem vaccine incident of Changchun Changsheng Company in Jilin Province exposed that the vaccine production enterprises were bent on profit, the local government and market supervision departments were negligent and oversight, and also reflected the system defects in vaccine production, circulation and use. Subsequently, the "People’s Republic of China (PRC) Vaccine Management Law" was drafted and promulgated, and the first vaccine law in China was also ready. In 2018, while the Quanjian incident broke out, health care industry’s chronic diseases continued to ferment, and there were many "God cases" of health food against cancer. Also known as the "health empire" — — Ranjian Global is also suspected of pyramid schemes. The company claims to have a health care "foreign juice" originating in the United States — — Morinda citrifolia juice can treat all kinds of "incurable diseases". However, Ranjian Global does not have any domestic approval and filing of health food. On November 20, 2018, the public security organs launched an investigation into Ranjian Global’s alleged pyramid schemes and commodity smuggling.
Comment: Although the government has continuously increased the supervision of the health care products market for many years, the chaos in health care industry has not been completely eradicated under the drive of huge interests. In the first half of 2018, users in ofo sharing bicycles began to be unable to refund their deposits normally. Didi windmill driver murder case challenges the safety bottom line
Event: On August 24, 2018, Zhao, a girl from Yueqing, Zhejiang Province, was raped and killed by the driver on the way to Yongjia by Didi Shunt. A dirty rag uncovers the hygienic chaos in a five-star hotel
Event: On the evening of November 14, 2018, netizens posted videos on the media platform, exposing the hygienic chaos of nearly 20 five-star hotels — — Hotel waiters use dirty towels picked up from the ground to wipe cups, hand basins, toilets, mirrors, etc., and no matter where they wipe, they only use this dirty towel all the time. The whole scene is amazing. There are many world-renowned five-star hotels such as Marriott, Sheraton, Shangri-La and Hilton. Hotels involved in various places have issued statements one after another, apologizing to consumers, saying that they have conducted a thorough investigation internally. On the second day after the exposure, the Ministry of Culture and Tourism instructed the cultural and tourism authorities of Shanghai, Beijing, Fujian, Jiangxi, Guizhou and other five provinces and cities to investigate and deal with it, and sent a supervision and inspection team to the exposed tourist hotels for on-site supervision and inspection. Seven hotels involved in Shanghai were given warnings and fined 2,000 yuan each.
Comment: Cleanliness, hygiene, safety and comfort are the core competitiveness of the hotel industry and the key for consumers to choose hotels. However, this dirty rag unveiled the gorgeous mask of a five-star hotel, revealing a dirty background and detonating the crisis of public confidence in the entire hotel industry. The lack of business ethics and honesty in these well-known five-star hotels has undoubtedly subverted consumers’ cognition and failed consumers’ trust. Event: In 2018, CCTV’s March 15th party and many media reported that in the rural consumer market, consumer goods became "waste products". On December 14, 2018, the Ministry of Agriculture and Rural Affairs, the Ministry of Commerce, the Ministry of Public Security, the State Administration of Market Supervision, China National Intellectual Property Administration and the All-China Federation of Supply and Marketing Cooperatives announced that they would launch a special rectification campaign for fake and shoddy food in rural areas to comprehensively "clean up" the rural food market. "Big data killing" is rampant in many fields and platforms
Event: In March 2018, a netizen exposed his personal experience: his long-term booking price on a website was 380— Hotel room between 400 yuan, and with a friend’s account query, the same room is shown as around 300 yuan. Subsequently, many netizens have exposed similar experiences, from hotel reservation, air ticket reservation to taxi travel. Whether it is Ctrip, Amazon, Didi, Flying Pig, many well-known Internet platforms have been exposed to such big data killing operations. Such behavior completely deprives consumers of the right to know and fair trade, and has become synonymous with Internet companies violating business ethics.
Comment: Big Data should be used to improve the operational efficiency of enterprises and provide consumers with more accurate and caring services. However, it has evolved into a "killing" sales tool. This not only violates the legitimate rights and interests of consumers, such as the right to know, the right to fair trade and the right to privacy, but also seriously deviates from the principle of fairness and integrity in the market economy. The processing and use of big data requires the restraint and supervision of relevant institutions, laws and regulations, technical ethics and other aspects. On January 1, 2019, the "Electronic Commerce Law" was officially implemented. According to Article 18 of the Bill, if an e-commerce operator provides search results of goods or services to consumers according to their hobbies, consumption habits and other characteristics, it should also provide the consumers with options that are not specific to their personal characteristics, and respect and equally protect the legitimate rights and interests of consumers. Although domestic airlines have clear regulations on ticket refund and change, many internet ticket sales platforms do not charge the refund and change fees according to this. According to the "Investigation Report on Refund and Change of Airline Tickets of Consumers in Jiangsu Province" issued by Jiangsu Consumer Protection Committee on April 24th, 30.7% of consumers have been charged a high fee for changing their airline tickets many days in advance. 23.5% of consumers have experienced that the refund fee is higher than the ticket price. The highest refund fee is actually three times the ticket price; Special fares are basically not refunded or exchanged, or only airport construction fees and fuel surcharges are refunded.
Comment: The refund and change fee is a kind of compensation fee similar to liquidated damages. Passengers who temporarily return and change their tickets may cause a certain degree of waste of resources for airlines. While the travel platform provides the service of returning and changing the ticket, it is reasonable to charge a certain fee, but the amount should be within the scope of reasonable compliance.
