Interim Measures of Beijing Municipality on Compensation for Water Ecological Regions
Chapter I General Provisions
Article 1 In order to further improve the management policy of water ecological protection and restoration in this Municipality, we urge all district governments in the river basin (including the Administrative Committee of Beijing Economic and Technological Development Zone, the same below) to implement the main responsibility of water ecological protection and restoration by economic means, promote the continuous improvement of water ecological health level, and build a "Happy River for the benefit of the people". According to the relevant provisions of the state and this Municipality, these Measures are formulated in accordance with the interest-oriented mechanism of "the protector benefits, the user pays and the infringer compensates".
Article 2 These Measures shall apply to the economic compensation activities carried out among the river basin governments within the administrative area of this Municipality to promote the protection and restoration of water ecology.
Article 3 These Measures shall be formulated in accordance with the following principles:
(1) Adhere to the problem orientation. Guided by promoting the high-quality development of the capital and aiming at promoting the water ecological health, the key factors and outstanding problems affecting the water ecological health are focused, and the assessment indicators and accounting methods are determined.
(2) Adhere to integrity and innovation. According to the work requirements of water ecological protection and restoration in the new stage, adjust the accounting standards of compensation funds, expand and enrich assessment indicators, improve policy-driven efficiency, promote the connectivity of rivers and lakes, and enhance the habitat and biodiversity of rivers and lakes.
(3) Adhere to simplicity. The assessment indicators and accounting methods not only follow the natural law of water ecological protection and restoration, but also adhere to the scientific and systematic nature, fully consider the realistic conditions, avoid seeking perfection, adopt the existing water ecological monitoring data and mature norms and standards, and strive to make the accounting methods clear, simple and operable.
Chapter II Assessment Indicators and Accounting Methods
Article 4 In view of the key factors affecting the aquatic ecosystem, three assessment indicators and thirteen accounting indicators are set.
(1) Water flow indicators. The assessment content includes water length and liquidity, and there are three accounting indicators.
Liquidity includes two accounting indicators: the removal of blocking facilities and the control of river blocking.
(2) Water environment indicators. The assessment content includes the annual task of water quality and sewage treatment, with eight accounting indicators.
The water quality includes pollutant concentration in cross-regional section and total nitrogen in upstream storage of Miyun Reservoir. Among them, the pollutant concentration in cross-regional sections includes three accounting indexes: ammonia nitrogen, total phosphorus and permanganate index (or chemical oxygen demand). The permanganate index is suitable for sections with water quality objectives of Class II and III, and the chemical oxygen demand is suitable for sections with water quality objectives of Class IV and V..
The annual task of sewage treatment includes four accounting indicators: sewage treatment project construction, sewage cross-regional treatment capacity, overflow pollution storage capacity and reclaimed water allocation and utilization capacity.
(3) Water ecological indicators. The assessment content includes habitat and biology, and there are two accounting indicators.
Habitat accounting indicators focus on river flow pattern, sediment, coastline, vegetation coverage and other factors.
Biological accounting indicators focus on the diversity and abundance of aquatic animals and plants.
For habitat and biological accounting indicators, refer to the survey scoring method in Technical Specification for Water Ecological Health Assessment (DB11/T1722—2020) to determine the scoring value, and assess the different ecological functions of mountainous and plain (country or city) river sections respectively.
Article 5 The accounting method for the compensation for the length of a river with water is:
(a) there is a long assessment of the implementation of inventory management. The assessment list of each district is based on the first water survey of 425 rivers in this city, and the uncontrollable seasonal rivers and municipal river sections are deducted. In case of special drought year, this indicator will not be assessed for the time being.
(two) the compensation payable by a river in a certain area is the annual assessment target value MINUS the length of the existing river in that year, and then multiplied by the compensation standard. The compensation shall be paid by the relevant district government responsible for reducing the length of the river, and the total compensation shall be accumulated according to the number of river sections.
(three) the annual assessment target value of a river with water is the average length of the river with water from March to June in the first three years of the river (excluding special drought years).
(4) The compensation standard for the length of rivers with water is 200,000 yuan/km and 600,000 yuan/km per year respectively according to the two situations of mountainous and plain rivers.
(5) The Municipal Water Affairs Bureau shall, jointly with the relevant district governments, formulate the assessment list of the length of rivers and the annual implementation plan of water source allocation, and organize relevant monitoring and evaluation work.
Article 6 The accounting method of liquidity compensation is as follows:
(1) Liquidity assessment shall be subject to list management, and the assessment list of blocking facilities in each district shall be formulated on the basis of the assessment list of water and river chiefs.
(two) the relevant district government should dismantle the river liquidity blocking facilities that no longer have the functions of flood control and water resources allocation in time according to the annual demolition plan. The relevant district governments that have not completed the annual demolition plan should pay compensation according to the total number of unfinished demolition multiplied by the individual compensation standard. The single compensation standard is 1.5 million yuan per place per year.
(3) For the blocking facilities that are not included in the annual demolition plan, when the downstream flow is cut off due to blocking, the compensation shall be calculated and paid cumulatively according to the number of blocking flows of each facility multiplied by the compensation standard. The compensation standard is 300,000 yuan per place.
(four) by the Municipal Water Affairs Bureau in conjunction with the relevant district government to develop blocking facilities assessment list, annual demolition plan and control management procedures, and organize relevant monitoring and evaluation work.
Seventh cross-regional cross-section pollutant concentration assessment and accounting methods are:
(1) When the pollutant concentration in the cross-regional section is lower than the water quality target value, the upstream district government of the section shall pay compensation to the downstream district government; When the pollutant concentration in the cross-regional section is better than the water quality target value, the downstream district government of the cross-regional section shall pay compensation to the upstream district government.
(2) The compensation for cross-regional pollutant concentration payable in a certain district is the sum of the compensation for the cross-regional section that is inferior to the water quality target value and the compensation paid for the entry section that is superior to the water quality target value. The compensation for the same cross-regional section shall be calculated monthly according to all accounting indicators.
(three) if the cross-regional section is cut off all month, the compensation for the section will not be calculated in that month; If the whole month is not cut off, the compensation for this section shall be calculated based on the average value of the monitoring data of the rainy days in that month; If the cross-regional section is located in the river section of the district boundary, the compensation shall be shared according to the proportion of pollutant discharge in the relevant areas within the basin; When the number of exit and entry sections of the same basin in the same area is inconsistent, the pollutant concentrations of multiple exit and entry sections will be weighted according to the average water volume of each section to calculate the compensation; When the concentration of pollutants in the cross section is lower than the target value of water quality due to illegal sewage discharge, the compensation shall be calculated based on the maximum concentration value monitored in the current month.
(four) according to the relevant requirements of the national surface water ecological environment quality assessment, combined with the actual situation of this Municipality, determine the target value of pollutant concentration and water quality in cross-regional sections; The monitoring method shall be implemented in accordance with the national technical specifications for surface water monitoring, and the specific monitoring scheme shall be formulated by the Municipal Bureau of Ecology and Environment.
(5) The setting of cross-regional sections is proposed by the Municipal Bureau of Ecology and Environment in conjunction with the Municipal Water Affairs Bureau and relevant district governments.
(VI) Compensation for pollutant concentration in cross-regional section shall be calculated according to the following standards: when the concentration of pollutants (chemical oxygen demand or permanganate index, ammonia nitrogen and total phosphorus) in cross-regional section is lower than the target value of water quality in this section, the compensation standard for such pollutants is 300,000 yuan/month for every functional category that its concentration deteriorates relative to the target value of water quality in this section. When the pollutant concentration in the cross-regional section is better than the water quality target value of the section, the compensation standard for this pollutant is 300,000 yuan/month for each functional category whose concentration is better than the water quality target value of the section.
When the concentration of any pollutants (chemical oxygen demand or permanganate index, ammonia nitrogen, total phosphorus) in the cross-regional section is lower than Class V, the compensation will be withheld for 5 million yuan/month at one time; When the section is worse than Class V for more than 3 months (inclusive) in a year, the total compensation for the section will be doubled and liquidated at the end of the year.
Article 8 The compensation for total nitrogen in the upstream storage of Miyun Reservoir shall be calculated in the way of "concentration control and total payment":
(a) when the total nitrogen concentration of the river storage section exceeds the assessment target value, the storage section shall pay compensation. The compensation amount is the total nitrogen whose concentration exceeds the assessment standard multiplied by the total nitrogen compensation standard, and the relevant district government will share the compensation for the storage section according to the proportion of the total nitrogen in the river storage.
(2) The assessment target value of total nitrogen in storage shall be determined by the Municipal Water Affairs Bureau in conjunction with the Municipal Bureau of Ecological Environment and relevant district governments in light of the actual situation, aiming at different storage rivers. The compensation standard is 1.57 million yuan/ton per year.
(three) when the total nitrogen concentration of the inflow river is greater than that of the inflow river, the compensation in this area will be doubled.
(4) The setting of total nitrogen assessment storage section and cross-regional section is proposed by the Municipal Water Affairs Bureau in conjunction with the Municipal Ecological Environment Bureau and relevant district governments.
(5) The Municipal Water Affairs Bureau shall, jointly with the Municipal Bureau of Ecology and Environment, organize the monitoring of total nitrogen concentration and water quantity in the assessment section, and formulate specific monitoring plans.
Ninth sewage treatment annual task compensation accounting method is:
(a) the relevant district government that fails to complete the annual sewage treatment project construction task on schedule shall pay compensation. The compensation amount is converted into sewage treatment amount according to the project design scale and the number of extension days, and multiplied by the compensation standard for accounting. The compensation standard is 2.5 yuan/ton.
(2) If sewage in a certain district is treated by sewage treatment facilities in other districts, the district government shall pay compensation for cross-regional treatment according to the cross-regional treatment capacity. The compensation amount is the cross-regional processing capacity multiplied by the compensation standard. The compensation standard is 2.5 yuan/ton.
(3) The relevant district government that fails to complete the annual construction task of overflow pollution storage facilities on schedule shall pay compensation, and the compensation amount shall be the project design storage scale multiplied by the number of times of rainfall of more than 15mm and less than 33mm, and then multiplied by the compensation standard. The compensation standard is 2.5 yuan/ton.
If overflow pollution enters the river due to the abnormal operation of overflow pollution storage facilities, the district government shall pay compensation. The compensation amount is the overflow polluted water multiplied by the compensation standard. The compensation standard is 2.5 yuan/ton.
(four) the relevant district government that fails to complete the annual task of allocation and utilization of reclaimed water on schedule shall pay compensation. The compensation amount is the difference between the annual allocation and utilization of reclaimed water and the assessment target value, multiplied by the compensation standard. The compensation standard is 1 yuan/ton.
(five) the annual task index of sewage treatment in each district is put forward by the Municipal Water Affairs Bureau in conjunction with the relevant district governments.
Tenth water ecological compensation accounting method is:
(a) in a certain area, if the score value of the habitat and biological accounting index of a certain river section fails to reach the assessment target value, the relevant district government shall pay compensation according to the habitat and biological accounting index respectively. The compensation amount is the difference between the target value and the score value of the assessment of habitats and organisms in the reach multiplied by the compensation standard of habitats and organisms respectively.
(2) The target value of habitat and biological assessment is determined according to the lower limit value of health grade in Technical Specification for Water Ecological Health Assessment (DB11/T1722—2020), and the compensation standard is 2 million yuan/minute and 3 million yuan/minute respectively.
(three) according to the classification assessment of mountainous and plain (country or city) river sections, and the implementation of inventory management, the Municipal Water Affairs Bureau in conjunction with the Municipal Ecological Environment Bureau, the relevant district government to develop a list of assessment river sections.
(four) by the Municipal Water Affairs Bureau in conjunction with the Municipal Bureau of Ecological Environment organization to carry out water ecological health monitoring and evaluation work, and formulate specific monitoring and evaluation plan.
Chapter III Accounting, Collection, Distribution and Use of Compensation
Eleventh compensation by the Municipal Water Affairs Bureau in conjunction with the Municipal Bureau of Ecology and Environment, the Municipal Finance Bureau to organize the district government accounting, according to the annual collection.
(a) there are long rivers, liquidity, sewage treatment annual task compensation by the Municipal Water Affairs Bureau, according to the annual accounting. Compensation for pollutant concentration in cross-regional sections shall be calculated monthly by the Municipal Bureau of Ecology and Environment. The total amount of total nitrogen and water ecological compensation in the upper reaches of Miyun Reservoir shall be organized by the Municipal Water Affairs Bureau in conjunction with the Municipal Bureau of Ecological Environment, and shall be accounted for annually.
(two) the Municipal Water Affairs Bureau, the Municipal Bureau of Ecological Environment and the Municipal Finance Bureau shall report the accounting results of the compensation payable in the previous year to the municipal government for examination and approval, and notify the district governments, and the municipal finance bureau shall settle with the district finance bureaus.
Twelfth compensation shall be distributed in accordance with the following provisions:
(1) Compensation paid for the long river, failure to complete the annual task of removing blocking facilities, blocking liquidity, total nitrogen in the upstream of Miyun Reservoir, construction of sewage treatment projects, storage of overflow pollution, allocation and utilization of reclaimed water, habitat and biological assessment, 70% will be allocated to the paying district government, and 30% will be compensated to the downstream district government.
There is a long river, the annual task of dismantling blocking facilities has not been completed, liquidity has been blocked, sewage treatment project construction, overflow pollution storage, reclaimed water allocation and utilization, habitat and biological assessment compensation. When the downstream is a municipal river course or other provinces and cities, and the upstream of Miyun Reservoir is Miyun Reservoir, the compensation will be coordinated by the municipal level.
(two) the cross-regional cross-sectional pollutant concentration is lower than the target value of water quality compensation to the downstream district government; Compensation arising from the appearance of inferior V water bodies in the cross-regional section for more than 3 months (inclusive), and when the downstream of the section is a foreign province or city, the compensation shall be co-ordinated by the municipal level. The compensation arising from the pollutant concentration in the cross-regional section being better than the water quality target value shall be compensated by the downstream district government to the upstream district government.
(three) the compensation paid for cross-regional sewage treatment, 30% by the municipal co-ordination, 70% compensation to the district government where the cross-regional treatment facilities.
Thirteenth compensation shall be used in accordance with the following provisions:
(1) Use of water flow compensation. There are long rivers, the annual task of dismantling blocking facilities has not been completed, and the compensation paid for blocking liquidity assessment should be used for the purchase of water sources (including reclaimed water), the dismantling of water flow blocking facilities, the transmission and distribution of water resources (including reclaimed water) and the protection and restoration of water ecology.
(two) the use of water environment compensation. The compensation paid by the cross-regional cross-section pollutant concentration assessment shall be used for the ecological environment protection of drinking water source areas, the treatment of inferior V water bodies, the cleaning and remediation of sewage outlets entering the river, the water ecological protection and restoration, and the construction, operation and maintenance of related monitoring facilities.
The compensation paid for the assessment of the total nitrogen in the upper reaches of Miyun Reservoir is all used for the total nitrogen control in the upper reaches of Miyun Reservoir.
The compensation paid for sewage treatment project construction, sewage trans-regional treatment, overflow pollution storage and allocation and utilization of reclaimed water shall be used for the construction, operation and maintenance of facilities such as water source (including reclaimed water) purchase, water resources transportation and distribution (including reclaimed water transportation and distribution), sewage collection and treatment, sludge disposal, overflow pollution storage and storage, and water ecological protection and restoration.
(three) the use of water ecological compensation. The compensation paid by the assessment of habitat and biology shall be used for the purchase of water sources (including reclaimed water), the transportation and distribution of water resources (including reclaimed water) and the protection and restoration of water ecology.
(IV) The municipal co-ordination part of the above three types of compensation shall be determined by the Municipal Water Affairs Bureau in conjunction with the Municipal Bureau of Ecological Environment and the Municipal Finance Bureau, taking into account the situation of water source protection, water source (including reclaimed water) purchase, water resources transmission and distribution (including reclaimed water transmission and distribution), water environment management and annual key areas and key work of water ecological protection and restoration in the whole city.
Article 14 The Municipal Water Affairs Bureau is responsible for organizing the formulation of compensation accounting rules for assessment indicators of water flow, water environment and water ecology except cross-regional pollutant concentration, the Municipal Bureau of Ecology and Environment is responsible for organizing the formulation of compensation accounting rules for cross-regional pollutant concentration, and the Municipal Finance Bureau is responsible for organizing the formulation of implementation rules for the management of compensation settlement and use.
Fifteenth kinds of compensation is not only the compensation for water ecological environment damage, but also the special funds for water environmental management and water ecological protection and restoration, and shall not be withheld, misappropriated or misappropriated for any reason or way. The compensation unit shall establish a special file to record the implementation of the project and the use of compensation. The financial departments of each district shall, jointly with the water affairs and ecological environment departments, submit the annual use of compensation in this district to the municipal finance, water affairs and ecological environment departments. The relevant departments of the city should regularly supervise and inspect the management and use of compensation funds in various districts and the implementation of the project; In violation of the provisions, the compensation will be deducted in the next year. If the circumstances are serious, the relevant departments shall investigate the responsibilities of relevant units and personnel according to the rules and regulations.
Sixteenth Municipal Water Affairs Bureau and Municipal Bureau of Ecology and Environment will report the assessment results of water ecological compensation in each district to the municipal government for approval, and then notify the district governments and announce them to the public in an appropriate way.
Chapter IV Supplementary Provisions
Seventeenth compensation standards and contents of these measures shall be revised in a timely manner according to the economic and social development of this Municipality and the protection and restoration of water ecology and water environment. The district governments may refer to these measures to establish a water ecological compensation mechanism between township governments (street offices) within their respective administrative areas.
These Measures shall be interpreted by the Municipal Water Affairs Bureau in conjunction with the Municipal Ecological Environment Bureau and the Municipal Finance Bureau, and shall come into force as of January 1, 2023. The Notice of the General Office of the Beijing Municipal People’s Government on Printing and Distributing the Measures for Regional Compensation of Water Environment in Beijing (for Trial Implementation) (No.57 [2014] of Beijing Zhengban Fa) shall be abolished at the same time.
